The title deed in Turkey

The title deed in Turkey is known as the Turkish real estate tapu, and it is the final document that the owner obtains after the completion of the purchase of a property in Turkey. It is a document that proves real estate ownership, in which the information of the property and the real owner of the property is officially registered in the Turkish Land Registry Department and the General Directorate of the Land Registry.

According to the Real Estate Registry Law in Turkey, foreign investors or those wishing to live on Turkish lands can buy real estate in Turkey and obtain a title deed or title deed.

Tapu in Turkey

According to Article 35 of the Real Estate Registry Law No. 2644, which entered into force, Turkey has abandoned the practice of reciprocity in owning real estate by foreigners belonging to countries that are prohibited from owning real estate in Turkey with restrictions placed on some countries.

Types of title deed, tapu in Turkey

The Turkish Tabu Department provides three types of Tabu. The quality of the title deed is determined by the current state of the property. The title deeds are determined according to the following:

1. The real estate easement document

The real estate easement document in Turkey is known as a temporary document to prove ownership of a property, as a real estate project will be built on it pending the completion of the project and obtaining the full title deed.

In general, the real estate easement deed protects real estate owners from falling into a legal violation, and protects them from paying financial fines. It gives you the ability to officially register the property in the Tapu Department, and the real estate easement deed is distinguished by the presence of a sign in the middle of the title deed.

2. The land easement title deed

The land easement title deed is the title deed that divides the real estate project into separate sections. After 70% of the construction is completed, the Land Registry Office proves that the entire building has been constructed in accordance with the Turkish Building Law. You can also obtain the properties of the building to be sold through this deed.

3. Full Title Deed

The full title deed in Turkey is the final document that the owner obtains after the completion of the construction process, through which the right to personal ownership is registered, and it is officially documented in the Tabu Department, and the official specifications and their conformity with the basic specifications and standards of the project are verified.

Types of Tapu:

The blue Tabu

The blue Tabu in Turkey is a land title deed document, which states that the property specified in the document does not belong to any building or house in Turkey, but rather land, and shows the information of the property, but in the event of a mortgage or restrictions, it does not appear in this type of bond.

This type contains the name of the property, details of the total area, location, and how to obtain it, by purchase or by inheritance. Its information is very limited. If you want to obtain the information of the specified property in full, you must search the property records in the Land Registry Department.

The red Tabu

The red Tapu in Turkey is the individual residential title deed defined by habitable real estate. The buyer obtains it when buying a habitable property in Turkey, such as an apartment or house.

The style and type of real estate is determined within the document and contains the mortgage, if any, and is divided into two parts:

Kat İrtifakı: This type shows the formal state of the building, meaning that the building is still under construction and has not yet been completed.

Kat mulkiyeti: After the completion of the construction process, and the completion of the project, the government authorities supervise the conducting of the property’s checks, to ensure that the written specifications match the construction specifications, after which the full red title deed can be obtained directly.

Once a kat mulkiyeti is obtained, it means that the property has a residential license, Tapu, issued by public authorities.

How to obtain a title deed

After making the final decision in the process of buying a property in Turkey and determining the type and location of the property, you can then purchase and obtain the title deed as follows:

  • Obtaining an appointment at the General Land Registry.
  • Show passport and identity card.
  • Pay the tapu fees.
  • Seller’s signature on the title deed.
  • The buyer’s signature on the title deed.
  • Obtaining a title deed of the property in the name of the new owner
